These Terms and Conditions (“Terms”) govern your access to and use of the Pusula Maps mobile application, websites, features, products, and related services collectively referred to as the “Services.”
Pusula Maps is provided by Digital Infrastructure. Digital Infrastructure is part of ERT Investment LLC. In these Terms, “Pusula Maps,” “Digital Infrastructure,” “ERT Investment LLC,” “we,” “us,” and “our” refer to the provider of the Services.
By downloading, accessing, or using Pusula Maps, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be legally capable of entering a binding agreement in your jurisdiction. Minors should use the Services only with appropriate parent or guardian involvement.
2. Navigation and Driving Safety
Navigation is assistance only. Remain attentive, obey laws, signs, and officials, avoid handheld interaction while driving, stop safely before entering information, and reject any unsafe, closed, or restricted route.
3. No Emergency or Autonomous-Driving Service
Pusula Maps is not an emergency-response service and does not operate or control a vehicle. Do not rely on it for emergency assistance or autonomous driving.
4. Location Permission
You may revoke location access through device settings. Navigation, traffic, parking, nearby-place, and ETA features may stop working or become less accurate.
5. License to Use Pusula Maps
We grant a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to use the Services in accordance with these Terms.
6. Acceptable Use
Do not use the Services unlawfully or unsafely; copy or commercially exploit them; reverse engineer or bypass controls; disrupt systems; scrape or extract competing data; introduce malware; submit false reports; re-identify people; infringe rights; or violate provider terms.
7. Saved Places and User Content
You retain ownership of saved places, reports, feedback, and other content you provide. You grant us the limited rights needed to process, display, secure, and support that content as part of the Services.
8. AI-Powered Features
AI output may be inaccurate, incomplete, delayed, or unsuitable. Check routes and recommendations before relying on them, and do not use AI output as official, professional, or emergency advice.
9. Community Information
Community reports may be false, delayed, incomplete, or outdated. They supplement—not replace—official signs, authorities, and your own judgment.
10. Third-Party Data and Services
The Services may rely on third parties for maps, routing, traffic, places, geocoding, parking, weather, speech, AI, analytics, hosting, and crash reporting. Their availability, accuracy, and terms are outside our control.
11. Apple-Specific Terms
These Terms are between you and Digital Infrastructure or ERT Investment LLC, not Apple. Apple has no obligation to provide maintenance or support and may be a third-party beneficiary as required by its platform terms.
12. Beta and Experimental Features
Beta features may contain errors, change without notice, disappear, perform unpredictably, or cause loss of local test data. Use them at your own risk.
13. Updates and Changes to the Services
We may update, add, suspend, or remove functionality. Compatibility with every device, operating system, vehicle, or CarPlay system is not guaranteed.
14. Intellectual Property
The Services, software, designs, branding, and related intellectual property belong to us or our licensors and are protected by applicable laws.
15. Feedback
If you send ideas or feedback, you grant us a broad, worldwide, royalty-free right to use it to operate, improve, and develop the Services without obligation to you.
16. Suspension and Termination
We may suspend or terminate access when reasonably necessary to protect users, comply with law, address misuse, or protect the Services. You may stop using the Services at any time.
17. Disclaimer of Warranties
To the fullest extent permitted by law, the Services are provided “as is” and “as available” without warranties of uninterrupted availability, accuracy, safety, fitness, or error-free operation.
18. Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost data, lost profits, route decisions, or third-party conduct arising from use of the Services.
19. Indemnification
Where permitted by law, you agree to defend and indemnify us from claims arising from your unlawful use, violation of these Terms, or infringement of another person’s rights.
20. Governing Law
These Terms are governed by United States law and the law of the state where ERT Investment LLC is organized, while preserving mandatory consumer protections that apply where you live.
21. Changes to These Terms
We may update these Terms as the Services or legal requirements change. Continued use after an effective update means you accept the revised Terms where permitted by law.
22. Severability and Waiver
If part of these Terms is unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver.
23. Entire Agreement
These Terms and incorporated policies form the agreement between you and us regarding the Services, except where another written agreement expressly applies.
