These Terms and Conditions (“Terms”) govern your use of Pusula Maps, operated by ERT Investment LLC through Digital Infrastructure, including the mobile application, website, navigation, search, account, friend, convoy, community, and AI features (collectively, the “Services”).
By creating an account, selecting the acceptance control during onboarding, or continuing to use the Services, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility
You must be legally able to enter into these Terms in your location. If you use Pusula Maps for an organization, you represent that you have authority to accept these Terms for that organization.
The Services are not directed to children under 13, and account features must not be used by anyone below the minimum digital-consent age applicable in their location without valid parent or guardian authorization.
2. Accounts
Navigation and basic search do not require an account. Account features are optional and support friends, Social Maps, and convoy invitations.
You are responsible for the accuracy of your account information, protecting access to your device and credentials, and activity performed through your account. You may not impersonate another person, create misleading profiles, transfer access to unauthorized users, or attempt to bypass account, App Attest, invitation, or blocking controls.
You may sign out or delete your account from Account & Friends. Deletion is permanent and removes associated server-side account data as described in the Privacy Policy. Removing the app without deleting the account does not by itself delete server-side account data.
3. Friends, Social Maps, and Convoys
Friend requests require acceptance. Location sharing is voluntary and remains off until enabled through an applicable sharing control. You are responsible for choosing trusted recipients, reviewing the precision and duration of sharing, and stopping sharing when it is no longer needed.
Do not use social features to stalk, harass, threaten, deceive, monitor without consent, or expose another person’s private information.
Convoy and friend information is provided for coordination and must not be treated as proof of another person’s identity, safety, availability, or exact real-world position. Network, device, battery, permission, and GPS conditions can delay or interrupt updates.
4. Acceptable Use
You may use Pusula Maps only for lawful personal or authorized business purposes. You may not interfere with the Services, scrape or bulk-export provider content, reverse engineer protected services except where law expressly permits it, submit false or dangerous community reports, automate account or social actions, evade blocks or moderation, upload content you do not have the right to use, introduce malware, or use the Services to facilitate harm or unlawful conduct.
5. Required Route-Guidance Notice
YOUR USE OF THIS REAL-TIME ROUTE-GUIDANCE APPLICATION IS AT YOUR SOLE RISK. LOCATION DATA AND GUIDANCE MAY NOT BE ACCURATE.
Always obey traffic laws, official signs, closures, speed limits, and current road conditions. Keep your attention on the road. Do not interact with the app while driving; use voice guidance or stop in a safe and lawful place before changing a route or setting.
Routes, lanes, traffic, speed limits, road names, parking information, community reports, and arrival estimates can be incomplete, unavailable, delayed, or incorrect. Reject any unsafe, closed, or restricted route.
6. No Emergency or Autonomous-Driving Service
Pusula Maps is not an emergency-response service and does not operate or control a vehicle. Do not rely on it for emergency assistance or autonomous driving. Call the appropriate emergency service when necessary.
7. AI and Recommendations
Pusula AI, predictive suggestions, driving scores, Heat Map insights, fuel or energy estimates, parking suggestions, and similar features provide automated assistance and estimates. They can be inaccurate and are not professional, safety, insurance, legal, financial, or mechanical advice. Verify material decisions using current real-world information.
8. Third-Party Services and Content
Maps, search results, routes, authentication, email delivery, AI processing, business details, photos, ratings, and other content may be supplied or processed by third parties. Their services can change or become unavailable and may be governed by their own terms and privacy policies.
Provider trademarks, map data, photos, reviews, and other content remain the property of their respective owners and may be used only as allowed by the Services and applicable provider terms.
9. Community and User Content
You remain responsible for profile information, community reports, feedback, and other content you submit. You grant Pusula a limited, worldwide, royalty-free license to host, process, reproduce, and display that content solely to operate, secure, and protect the relevant feature. You retain ownership of content you create.
Pusula may remove content or restrict accounts when reasonably necessary to address abuse, safety, legal, or service-integrity concerns. Community reports may be false, delayed, incomplete, or outdated and do not replace official signs, authorities, or your own judgment.
10. License and Intellectual Property
We grant you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to use the Services in accordance with these Terms.
The Services, software, designs, branding, and related intellectual property belong to ERT Investment LLC or its licensors and are protected by applicable law.
11. Apple-Specific Terms
These Terms are between you and ERT Investment LLC, not Apple. Apple has no obligation to provide maintenance or support for the Services and may be a third-party beneficiary as required by its platform terms.
12. Availability, Beta Features, and Changes
Pusula Maps may add, change, suspend, or discontinue features. Beta or experimental features may contain errors, perform unpredictably, or cause loss of local test data. Compatibility with every device, operating system, vehicle, or CarPlay system is not guaranteed.
We may update these Terms when the Services or law changes. Material updates will be reflected by a new effective date and, when appropriate, an in-app notice or renewed acceptance. Continued use after an effective update constitutes acceptance where permitted by law.
13. Feedback
If you send ideas or feedback, you grant us a worldwide, royalty-free right to use them to operate, improve, and develop the Services without obligation to you.
14. Suspension and Termination
You may stop using the Services at any time. Pusula may suspend or terminate access to account or social features when reasonably necessary to protect users, comply with law, investigate abuse, or preserve service security.
Provisions that by their nature should survive termination, including ownership, disclaimers, limitations, and dispute-related provisions, remain effective.
15. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PUSULA MAPS IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ACCURACY, AVAILABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, SAFETY, OR UNINTERRUPTED OPERATION. NOTHING IN THESE TERMS EXCLUDES WARRANTIES OR RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ERT INVESTMENT LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOSS OF DATA, LOST PROFITS, OR LOSSES ARISING FROM RELIANCE ON ROUTING, LOCATION, SOCIAL, COMMUNITY, OR AI INFORMATION. LIABILITY THAT CANNOT LAWFULLY BE LIMITED REMAINS UNAFFECTED.
17. Indemnification
Where permitted by law, you agree to defend and indemnify ERT Investment LLC and its affiliates from claims arising from your unlawful use of the Services, violation of these Terms, or infringement of another person’s rights.
18. Governing Law
These Terms are governed by applicable United States law and the law of the state where ERT Investment LLC is organized, without overriding mandatory consumer protections in your place of residence.
19. Severability, Waiver, and Entire Agreement
If part of these Terms is unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver.
These Terms and the Privacy Policy form the agreement between you and us regarding the Services, except where another written agreement expressly applies.
